Terms of Service

Aseef provides software and infrastructure to create and manage brainstorming spaces, ideas, structured reaction blocks, collaboration features, export, search, presentation mode, and related functionality, as offered from time to time.

You must provide accurate registration information and maintain the confidentiality of your credentials. You are responsible for activity under your account. Notify us without undue delay of any unauthorised use or security incident of which you become aware.

You retain ownership of intellectual property rights in content you submit to the Service. You grant Aseef a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute such content solely as necessary to operate, maintain, improve, and promote the Service in accordance with your actions and settings (including rendering spaces, syncing collaborators, and enabling features you use).

You represent and warrant that you have all rights necessary to grant the foregoing licence and that your content does not violate these Terms or applicable law.

You shall not use the Service in any manner that violates these Terms or applicable law. Without limitation, you shall not:

• Violate law or infringe the intellectual-property, privacy, or other rights of any third party.
• Harass, threaten, or harm others, or distribute malware or unsolicited bulk or commercial messages.
• Attempt unauthorised access to the Service, other accounts, or related systems.
• Interfere with or disrupt the integrity or performance of the Service, except as permitted under published APIs and rate limits.
• Bypass or disable security features, usage limits, or access controls.

Hosts may invite collaborators and configure certain permissions. Your use of shared spaces is also subject to reasonable instructions of the host and the functionality of the product. We may limit or terminate access where required to protect the Service or other users.

The Service relies on third-party products (including authentication, hosting, and messaging). Their use is subject to the third parties’ terms and privacy notices. Aseef is not responsible for third-party services outside its control.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ASEEF OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. THE AGGREGATE LIABILITY OF ASEEF AND ITS OPERATORS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO ASEEF FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD 100), EXCEPT WHERE LIABILITY MAY NOT BE LIMITED UNDER MANDATORY LAW.

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Aseef and its operators from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your content or your breach of these Terms.

You may cease using the Service at any time. We may suspend or terminate access for breach of these Terms, risk to the Service or third parties, or as required by law. Provisions that by their nature should survive termination shall remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of the Aseef deployment you use is established, without regard to conflict-of-law principles. Subject to non-waivable rights under the laws of your residence, courts in that jurisdiction shall have exclusive venue over related disputes.

We may revise these Terms. Revised Terms will be posted with an updated effective date. Continued use after the effective date constitutes acceptance, except where law requires additional notice or consent.
